AE OTC Services, LLC, provides custodial trade escrow services solely for institutions and professional traders who are eligible contract participants, lawfully trading OTC derivatives referencing securities, currencies, and other excluded commodities, under the express provisions 1a(12), 1a(13), 1a(31), 2(d)(2), and 2(e) of the Commodities Exchange Act (CEA), as amended, and under 3(a)(5)(55)(A) of the Securities Exchange Act of 1934. All eligible contract participants at the escrow services facility are reminded that, as with all OTC trades, they remain subject to CFTC jurisdiction, under any applicable anti-fraud or anti-manipulation provisions under the CEA, and/or subject to SEC jurisdiction, under similarly applicable anti-fraud or anti-manipulation provisions of federal securities laws.
